1. Agreement to Terms
By accessing and using the services of Quantum Build Solutions ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services Description
Quantum Build Solutions provides construction estimation and material takeoff services, including but not limited to:
- MEP (Mechanical, Electrical, Plumbing) estimating services
- Concrete estimating services
- Painting estimating services
- Steel estimating and detailing
- Masonry takeoffs
- Lumber takeoffs
- Other construction-related estimation services
3. Use of Services
3.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these requirements.
3.2 Account Registration
When you create an account or request our services, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.3 Prohibited Uses
You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon the rights of others
- Transmit any viruses or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our services
4. Project Information and Confidentiality
When you submit project information for estimation:
- You represent that you have the right to share such information
- You grant us permission to use this information to provide our services
- We will maintain confidentiality of your project information
- We will not share your project details with third parties without your consent, except as required by law
5. Pricing and Payment
5.1 Pricing
Our pricing is based on project scope and complexity. We provide quotes before beginning work. Prices are subject to change, but we will honor quoted prices for accepted projects.
5.2 Payment Terms
Payment terms will be specified in your project agreement. Generally, payment is due upon completion of services or as otherwise agreed. Late payments may incur additional fees.
5.3 Refunds
Refund policies will be specified in your project agreement. Generally, refunds are not available for completed work, but we will work with you to resolve any concerns.
6. Deliverables and Turnaround Time
We strive to deliver accurate estimates within the agreed timeframe (typically 24-48 hours for standard projects). However:
- Deliverables will be specified in your project agreement
- Turnaround times are estimates and may vary based on project complexity
- We will communicate any delays promptly
- Our estimates are based on the information you provide
7. Accuracy and Limitations
While we strive for accuracy:
- Our estimates are based on the information and drawings you provide
- Actual costs may vary due to market conditions, material availability, and other factors
- We are not responsible for cost overruns or project delays
- Our estimates are for bidding purposes and should be verified independently
- We maintain a 92%+ bid-winning ratio, but cannot guarantee project awards
8. Intellectual Property
All estimates, takeoffs, and deliverables created by Quantum Build Solutions remain our intellectual property until full payment is received. Upon payment, you receive a license to use the deliverables for your project. You may not resell, redistribute, or use our work for other projects without written permission.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount paid for our services
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for decisions made based on our estimates
- We are not liable for project delays, cost overruns, or bid outcomes
10. Indemnification
You agree to indemnify and hold harmless Quantum Build Solutions, its employees, and affiliates from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another.
11. Termination
We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for any breach of these Terms of Service. You may terminate your use of our services at any time by discontinuing use and notifying us.
12. Dispute Resolution
Any disputes arising from these terms or our services will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with applicable laws, unless otherwise required by law.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of our services after changes become effective constitutes acceptance of the new terms.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Quantum Build Solutions operates, without regard to its conflict of law provisions.
